How should an employer manage a probation period review?

A fair probation review should use clear expectations, regular feedback and a documented decision to confirm, extend or end employment.

Set clear performance and conduct expectations at the start of probation, hold regular check-ins, give specific feedback and keep proportionate records. Before the stated end date, meet with the employee and confirm the outcome in writing: successful completion, an extension where the contract allows and there is a sound reason, or dismissal following a fair process.

Probation does not remove an employee's statutory rights. Employers should consider discrimination, automatically unfair dismissal, contractual notice and any relevant workplace procedure before making a decision.
