What are the statutory notice periods for employees in the UK?
Employees with at least one month's service are usually entitled to minimum statutory notice, which increases with length of service up to 12 weeks.
When an employer dismisses an employee, the statutory minimum is generally at least one week's notice after one month of service, then one week for each complete year of service from two to 12 years, capped at 12 weeks. A contract can give more notice, but not less than the statutory minimum.
Different rules can apply where employment ends for gross misconduct, where a fixed-term contract ends, or where payment in lieu of notice is used. Employees who resign must normally give at least one week's notice after one month of service unless their contract requires more.
